By creating an account, accessing, or using PresetLab.ai ("Service," "we," "us," or "our"), you ("User," "you") agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service. You must be at least 13 years old to use PresetLab.ai.
PresetLab.ai is a web-based application that uses artificial intelligence to generate synthesizer preset files ("Presets") based on natural language descriptions provided by users. The Service currently supports U-He Diva (.h2p format), with additional synthesizers planned.
Generated preset files are delivered directly to you for download and are not stored on our servers after delivery. The Service is intended for music producers, sound designers, and electronic music artists who own or license the supported synthesizer software.
You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and to keep this information updated.
We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or abuse the Service.
Free Tokens: New accounts receive a limited number of free generation tokens ("Free Tokens") at no cost. Free Tokens are non-transferable, non-refundable, and expire upon account termination.
Subscriptions: Paid subscription plans provide monthly token allowances that reset each billing cycle. Monthly tokens do not roll over to the next period. Subscriptions are billed in advance on a monthly or annual basis via our payment processor, Stripe.
One-Time Top-Ups: Token top-up packs are one-time purchases. These tokens never expire and are available for use across any active or future plan.
Refunds: All purchases are final and non-refundable, except where required by applicable law. If you experience a technical failure resulting in a token being consumed without a successful preset delivery, please contact us and we will review and issue a token credit at our discretion.
Cancellations: You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of your current billing period. No refunds are issued for unused tokens on the cancelled plan.
Production use licence: Preset files generated through the Service are licensed to you for use in your own music productions, including commercial releases. You may load, play, and modify a generated preset within your synthesizer software. This licence is personal, non-exclusive, and non-transferable.
No resale or redistribution: You may not resell, sublicense, redistribute, or repackage generated preset files, in whole or in part, as standalone products or as part of a preset pack, sample library, or similar offering. Preset files retain PresetLab.ai metadata attribution and may not have that attribution removed or altered.
No exclusivity guarantee: Because the AI generation process is probabilistic, we cannot guarantee that two users describing similar sounds will not receive functionally similar presets. We make no warranty of exclusivity.
Our IP: The PresetLab.ai platform, brand, software, AI models, and interfaces remain our exclusive property. You may not reverse-engineer, scrape, reproduce, or distribute the Service or its underlying technology.

The Service uses third-party providers including Clerk (authentication), Stripe (payments), an AI language model service provider (AI generation), and PostHog (analytics). Your use of the Service is also governed by their respective terms and privacy policies. We are not responsible for the practices of these third parties.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that (a) generated presets will meet your specific requirements or expectations; (b) the Service will be uninterrupted, error-free, or secure; or (c) AI-generated output will be free from defects. The quality and character of generated presets is inherently variable.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRESETLAB.AI AND ITS OWNERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for violations of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including IP rights, disclaimers, and limitations of liability) will continue to apply.
We may update these Terms at any time. We will notify you of material changes by updating the "Last updated" date at the top of this page. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through good-faith negotiation. If resolution cannot be reached, disputes shall be submitted to binding arbitration or the courts of competent jurisdiction.
